Its so difficult to have faith in a legal system that blatantly does not support you.
If you dont have the registration they fob you off with a generic letter, getting CCTV footage even if there was a camera is almost impossible. The police refer you to the local council who wont release it to you, unless the police request it! Its part and parcel of the Data Protection Act (See what I mean by catch 22!) Even trying to get an insurance company to get it doesn't work, as it conveniently gets taped over every 30 days. The police even state that most of the time the camera could be pointing the other way, or the view could be obscured by a truck or pedestrian so is never much use. [Here is an interesting fact though: If you jump a light, or get a fine and you want to immediately oppose it, you can go to the police station and see the footage IMMEDIATELY. Ha ha!]
If its a hit and run, and you don't call the police or ambulance immediately it takes weeks/months to try find the guy as a criminal case has to be opened. If you have the registration at the scene of the crime they can go knock on the guys door that same day! If Im not mistaken a Criminal and Claims case cannot run simultaneously either, and the Claims case may be dependent on the Criminal case? (Either way drawing things out a whole bunch more!)
Without a witness it mostly wouldn't even make small claims court, as its their word against yours. Even if you call the cops over and point the car out that just tried to run you over, you will get fobbed off and told that you are wasting your own time.
Basically what the hell are you supposed to do to get a sense of justice??
If you are hell bent on justice stay down, don't get up from the road for nothing. Call an ambulance and the police will come out as well. Make sure you have the license plate correct. Get takin to hospital and get checked out even if you think there is nothing wrong. Then you have the ball rolling.
If you're expecting justice then I'm afraid that you're going to be disappointed. The criminal justice system are the front line troops in the class war being fought in this country. As such their job is to protect the rich from the poor, you my friend as both a cyclist and a self-employed sub-contractor doing piece work and getting your pay weekly fall under the category of 'protect from' rather than 'protect'.
Having said that,to protect the charade of democracy sometimes, albeit rarely, it will allow a result, so it's worth reporting it. Just don't hold your breath waiting for anything approaching justice, we wouldn't want you dying from asphyxiation now would we?
